37th Annual National Conference on Equine Law – Rosenberg College of Law

Attorney, Peter Sacopulos, was a presenter at the 37th Annual National Conference on Equine Law. This conference was sponsored by the University of Kentucky and is held annually in Lexington, Kentucky. Mr. Sacopulos’ s presentation was: “The Horse Racing and Safety Act- Litigation Update”. Mr. Sacopulos presented to more than a hundred equine practitioners from more than thirty different states, as well as from Canada and the Netherlands. 

Mr. Sacopulos is national counsel for the North American Association of Racetrack Veterinarians (NAARV) and authored an Amicus Brief on behalf of his client in connection with the constitutional challenge that is pending before the Fifth Circuit Court of Appeals in New Orleans, Louisiana. As part of his presentation, Mr. Sacopulos outlined the constitutional challenges to the Horseracing Integrity and Safety Act which include the following: 1.) That HISA violates the Non-Delegation Doctrine of the United States Constitution, 2.) That HISA violates the Due Process Clause of the United States Constitution, 3.) That HISA violates the Appointment Clause of the United States, 4.) That HISA violates rules prohibiting Anti-Commandeering, 5.) HISA’s enforcement mechanism and the Authority’s enforcement rules violate the Seventh Amendment by forgoing a jury trial for monetary penalties, 6.) HISA violates Article III of the United States Constitution because it calls for the adjudication of claims to be done via an administrative process without a jury trial or a de novo factual review by a politically insulated and neutral federal judge, 7.) HISA authorizes search and seizure powers outside the scope of the Act and in violation of the Fourth Amendment, and 8.) HISA violates the Administrative Procedures Acts by calling for the adjudication of claims to be done via an administrative process without a jury trial or a de novo factual review by a politically insulated and neutral federal judge. 

In addition, he provided a litigation update for the six constitutional challenges that are pending in four different federal circuits, those being the Fifth, Sixth, Eighth and Tenth. 

Mr. Sacopulos continues to be actively involved in representing clients in connection with the constitutional challenges to this newly enacted federal legislation that governs thoroughbred racing.

It is designed for attorneys who counsel, represent, or litigate on behalf of buyers, sellers, breeders, brokers, owners of interests in horses, and other entities involved with the industry.
